The conference is going to describe the civil law concept of superficies and detail some of the unexpected consequences of the renovation of the Quebec cadastral system on this modality of ownership. In particular, I will be describing how, because of an administrative decision that was made regarding what rights of superficies would be recognized by separate lot numbers at the time of the renovation, beneficiaries of superficiary rights are now faced with a two-fold dilemma that affects the marketability of their rights and their ability to obtain financing. The conference will also discuss park tax, vertical splitting of lots and other related matters. The conference is going to focus on how this seemingly obscure implication comes up often enough in the context of a commercial real estate practise and the solutions that we have found to deal with these issues.
